1. Scope of application
These General Terms and Conditions of Contract apply to all orders placed through kolie925.com (hereinafter referred to as the "website"). It is essential to read these General Terms and Conditions carefully before ordering products from the website. By ordering our products, you accept the following conditions and declare that you are eligible to enter into legally binding contracts and are at least 18 years old. Any changes to the General Terms and Conditions of Contract will only be recognized if proven by us in writing. The current provisions also apply following changes made to the existing clause using written form.
2. Parties to the sales contract
The website and the sale of items via the Internet are managed by Mattia Mazza Srl, Via Marconi 70 - 80059 Torre del Greco Napoli. Any claim or request made during the warranty period must be sent to the aforementioned company.

3. Conclusion of the sales contract
All orders received through the website constitute a contractual obligation with Mattia Mazza Srl. We are free to accept or, by sending you a declaration in this regard, to refuse such an offer within 14 days of the order delivery. The purchase contract for the ordered goods is binding from the moment your order is accepted. This acceptance will be declared by the shipment of the ordered goods.
You declare your explicit consent to our solvency check, which will be carried out by consulting authorized credit protection associations, credit institutions and information agencies. We reserve the right not to accept the order in the event of negative information regarding solvency. We also reserve the right to refuse customer orders if there is reason to believe that the customer does not comply with the general conditions, participates in fraud or other relevant criminal activities, or if there is another important reason.
4. Availability
Products and prices are valid as displayed on the website; products are available while stocks last. We reserve the right to change the products displayed on the website at any time and without notice and to limit the number of pieces purchasable by a customer.
We assume no responsibility for lack of available stock or for products no longer available.
It is absolutely forbidden to resell or distribute any Mattia Mazza Srl product purchased from the website.
It is important to note that after order confirmation, order changes or cancellation requests cannot be taken into consideration.
5. Reservation of performance in case of unavailable items
Should the ordered items not be available within 30 days from the order date, we reserve the right to withdraw from the sales contract, even if the sales contract had been previously confirmed. In case of withdrawal from the contract, we will inform you and immediately refund the amounts received.
6. Prices and additional costs
The total order amount, including all taxes and costs for packaging and delivery, is indicated on the previous page or during the completion of the purchase procedure. By confirming the order, you declare that you accept the price of the chosen goods. Subsequently, it is no longer possible to change the amount due.
The sale of Kolie products takes place through Mattia Mazza Srl, based in Italy. Please note that for international credit card payments, your credit card issuing institution may apply an additional international fee (approximately 1-2%).
7. Payment conditions
The purchase price of the ordered items is due from the moment Mattia Mazza Srl receives the order. The order will be processed immediately upon receipt of payment. The amount is due immediately. Payment must be made by credit card, PayPal or bank transfer on the website. The amount due cannot be disputed unless the sum is challenged by a court order.
In case of credit card payment, we reserve the right to check the validity of the credit card, the availability of the charge, and the address. If the card issuing institution refuses payment availability, we do not guarantee for delays or non-delivery. If we do not receive the amount within 7 business days from order confirmation, Mattia Mazza Srl reserves the right to cancel the order.
8. Delivery and retention of title
The items will be delivered to the indicated address and shipped by a postal courier chosen by us. Mattia Mazza Srl undertakes in a non-binding way to deliver the items by the requested date. Please allow an additional 2-3 business days for personalized products. In the section dedicated to our online assistance, you can find our holidays on which orders are not processed. If you wish, we will try to deliver the goods on a specific date, but we generally cannot guarantee it in a binding way. The products will remain our property until the total amount due has been paid.
Upon delivery, check the correctness and completeness of the shipment and refuse delivery if the packaging is not intact or damaged.
9. Right of withdrawal
As a consumer, you have the right to withdraw from the contract, without giving any reason, within 14 days. Personalized products are excluded from the right of withdrawal.

Tel. 0818814866 info@mattiamazza.it) of your decision to withdraw from this contract by means of an explicit statement (e.g. a letter sent by post or email). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we will reimburse to you all payments received from you, excluding the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
The reimbursement may be suspended until receipt of the goods or until the consumer has demonstrated that they have returned the goods, whichever is earlier.
You must return the goods to the address found on the website under "Customer Service – Right of Withdrawal" immediately and in any event within fourteen days from the day on which you informed us of your wish to withdraw from the contract. The deadline is met if you return the goods before the expiry of the 14-day period. Further information and help for returning ordered goods and the return address in your country can be found on our website under the menu item "Customer Service – Right of Withdrawal".
The costs of returning the goods will be borne by you.
Any loss in value of the goods is your responsibility only if this loss in value is necessarily attributable to you after an evaluation of the consistency, properties, and function of the goods.
The customer must return the products in their original condition, in their original packaging, and the products must be accompanied by the return slip.
Please note that by paying entirely with a Gift Card, the amount paid can only be refunded in the form of a Gift Card. If a partial payment is made with a Gift Card, the amount paid via your chosen payment method will first be refunded via the same payment method. Any remaining amount will then be reloaded onto your Gift Card.
In general, vouchers and personalized products cannot be exchanged or returned.
It is currently not possible to return goods purchased from a Mattia Mazza Srl retailer via the website.
If you decide to return only part of an order purchased as part of a discount/offer, the refunded amount will be subject to the minimum purchase amount related to the offer, the discount value will be adjusted accordingly, and only the amount related to the returned item will be refunded. If the value of the returned items means that the remaining total is less than the minimum purchase level of the offer, then the discounted amount will be deducted from the refund amount. For example, a 10% discount (with a minimum purchase amount of EUR 100) will be deducted if the product (or products) causes the total order value to be less than EUR 100. In the case of a tiered pricing promotion, the lower amount will always be refunded.
10. Warranty
Should the delivered items have defects, you may proceed with the termination of the contract or, at your option, if the goods are still available, request their replacement with a defect-free item. No other warranty will be granted in addition to the one just mentioned.

The warranty period is 2 years from the date of delivery.
11. Limitations of liability
Mattia Mazza Srl only guarantees for damages resulting from willful misconduct or gross negligence.
The above limitations of liability shall apply to all claims for compensation, regardless of the legal grounds, including claims arising from tort; they shall not apply in any eventual case under the Product Liability Act (LRDP), for a guaranteed property, or for injury to life or body.
The exclusion or limitation of liability for damages under the above paragraphs shall also apply to any claims for compensation against the employees or authorized representatives of Mattia Mazza Srl.
12. Severability clause
Should any of the clauses of these general conditions become ineffective or unenforceable, the remaining clauses shall remain unchanged.
13. Prohibition of assignment
The rights belonging under the contract may only be assigned to third parties with the prior written consent of Mattia Mazza Srl.
14. Applicable law
Contracts concluded on the basis of these General Terms and Conditions of Contract are governed by Italian law, and any reference to the laws of other countries is excluded. The rules of the United Nations Convention on Contracts for the International Sale of Goods (CISG) will not apply. This applicable law is valid only to the extent that mandatory provisions of the legislation of the consumer's country of residence do not oppose it. Naples is the exclusive forum for all disputes arising from or in connection with these General Terms and Conditions of Contract. Mattia Mazza Srl also reserves the right to take legal action in the customer's place of residence.
